MOSAID Technologies Inc: Texas Court Denies Infineon's Motion to Change Venue
OTTAWA, Ontario, Canada – October 17, 2005 - MOSAID Technologies Incorporated (TSX:MSD) today announced that United States District Judge Davis issued a Memorandum Opinion and Order denying Infineon's motion to transfer the case from the Eastern District of Texas, Tyler Division to the Northern District of California for consolidation with the MOSAID/Infineon case which is currently before the Court in California.
In April 2005 MOSAID initiated litigation against Infineon Technologies AG and three of its U.S.-based affiliates for infringement of three of MOSAID's United States patents. The suit was filed in the United States District Court for the Eastern District of Texas, Tyler Division.
The schedule for the proceedings in this case includes: Mediation, which is expected to take place between January 6 and February 24, 2006; the Markman Hearing, which is expected to commence on April 6, 2006; and the Jury Trial, which is scheduled to begin on October 10, 2006.
