Wi-LAN Litigation Update
OTTAWA, Canada – June 5, 2009 – Wi-LAN Inc. (“Wi-LAN” or the “Company”) (TSX:WIN), a leading technology innovation and licensing company, today provided a litigation update pertaining to the claims filed on September 30, 2008 by Intel Corporation (“Intel”) in the Northern District of California requesting a declaratory judgment that 18 of Wi-LAN’s U.S. patents are invalid and have not been infringed. Wi-LAN brought a motion to dismiss or transfer this Intel lawsuit, which was argued before U.S. District Judge Ware on May 4, 2009.
In a ruling received by Wi-LAN today, Judge Ware granted Wi-LAN’s motion to transfer to the Eastern District of Texas all claims of Intel involving Wi-LAN’s U.S. patent 6,549,759. Judge Ware denied Wi-LAN’s motion to dismiss or transfer the claims relating to the other Wi-LAN patents named in Intel’s action in the Northern District of California. Judge Ware also scheduled a case management conference for this lawsuit which will be held on June 22, 2009.
